I acknowledge, agree, and represent that I understand the inherent risks and dangers of damage to personal property and serious bodily injury, including permanent disability, paralysis, Lyme and other diseases from ticks, and death in participating in a river-based event. I am qualified, in good health, in proper physical condition to participate in this activity, and willing to comply with the stated and customary terms and conditions of participation. All participants share in the responsibility for their own safety and the safety of the group. I take responsibility for having appropriate skills, equipment, and supplies for this activity. I knowingly and freely assume all risks involved, both known and unknown, including any risks involved in my use of any equipment supplied to me for this event. In consideration of the right to participate in this event, I, for myself, my heirs, and my personal representatives, hereby voluntarily agree to release, promise not to sue, and agree to hold harmless the following, both personally and in their representative capacities: (a) OARS, Inc., its officers, directors, employees, and members, (b) the event leaders and other individuals and sponsors associated with this event, (c) other participants, and (d) any landowners whose land borders the river or whose land will be used as part of the event (collectively, the “Releasees”) with respect to any claim for injury, damages, or loss sustained of any kind, from any cause whatsoever, arising from my participation in this river-based event. I acknowledge that the above-listed Releasees assume no responsibility for any accident or injury sustained by me (including injuries resulting in my death) or damage to or loss of equipment prior to, during, and after the event. I understand that by signing this document, I am agreeing here to waive all claims I may have against these Releasees and agree that neither I nor anyone acting on my behalf will make a claim or file a lawsuit against any of the Releasees. I further agree that if, despite my signing this document, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify and hold harmless each of the Releasees from any legal expenses, attorneys’ fees, losses, liabilities, damages, or costs that they may incur as a result of such claim. I have carefully read, understand, and voluntarily sign this document and acknowledge that it shall be effective and binding upon me, my minor children, and other family members, and my heirs, executors, representatives, and estate. I give permission for OARS and their sponsors, television or newspaper reporters, and all other commercial exhibitors to use photographs and/or videos taken during this event.
